General Terms and Conditions of Sale of the Regional Sports Parachuting Center (CERPS)
GENERAL TERMS AND CONDITIONS FOR PARTICIPATION IN A TANDEM OR AFF PARACHUTE JUMP
Agreement with CERPS The contract with CERPS takes effect on the date of the actual payment of the gift voucher or the reservation.
Contract Duration and Termination a. The contract remains in effect until the jump is completed or for a period of one year after the payment is received. If the jump has not been completed by this date, CERPS will no longer have any obligations. b. During the duration of the contract, the buyer can terminate it within the first 14 days. In such cases, CERPS will refund the full amount paid. After this period, no refunds will be made. The gift voucher is not nominative and can be transferred to another person, but written confirmation from the voucher holder will be required.
Validity of Gift Vouchers or Reservation Vouchers a. Gift vouchers are valid for one year unless otherwise specified due to a special promotion or campaign (see expiration date). b. If the voucher is expired for less than six months, it can be extended for an additional six months upon payment of a €50 fee. The additional six months begin from the original expiration date, not from the payment date. c. If the voucher is expired for more than six months, it can no longer be extended and is permanently invalid.
Refund Policy There will be no full or partial refund of the jump price if the tandem passenger or AFF student refuses to board the plane within 30 minutes before the flight or refuses to jump after boarding.
AFF Training The deposit paid before the AFF training is non-refundable. Jumps paid in advance and not completed are also non-refundable. CERPS may consider a refund (excluding the deposit) in exceptional circumstances but may deduct administrative fees.
Group Reservations For group reservations of four or more tandem jumps, a deposit of 50% of the total amount is required. This must be transferred within one week of the reservation to validate it. The deposit will not be refunded and will be forfeited if: a. The reservation is canceled less than 48 hours before the appointment. b. Participants do not show up on the day and time of the jump. c. The number of participants jumping is less than the number reserved. The portion of the deposit for the missing participants will not be refunded and will be forfeited. d. Participants wish to postpone the appointment less than 48 hours before the initial booking.
Modifications All provisions in these Terms and Conditions may be subject to change during promotions or campaigns by the Paraclub Namur. The club reserves the right to modify the validity period of a voucher, the jump price, or any other element related to a gift voucher or reservation, with prior notification to clients during the relevant promotion or campaign.
Qualified Instructors and Equipment Jumps are conducted with experienced instructors who are certified as Tandem Masters and/or AFF Instructors by a recognized federation. All parachutes used are equipped with an Automatic Activation Device (AAD) that deploys the reserve parachute if necessary. The reserve parachute is steerable and similar to the main parachute.
Insurance a. Thanks to the competence of Tandem Masters/AFF Instructors and the quality of the equipment used, skydiving involves minimal accident risk. However, even in optimal conditions, the risk of injury cannot be entirely excluded. CERPS provides personal injury and liability insurance for each tandem passenger. The full AFF training price includes insurance valid until December 31 of the current year. b. The Tandem Master is covered by liability insurance for any damages caused as the operator of an aircraft during the jump. The pilot and aircraft owner are also covered by civil liability insurance as required by law. c. The tandem passenger releases the Tandem Master, the equipment owner, the pilot, the aircraft owner, CERPS, and its staff from any liability not covered by the aforementioned insurances.
Availability and Execution of Jumps The availability and execution of tandem and AFF jumps are exclusively determined and organized by CERPS and its staff. Weather conditions or operational limitations may lead to waiting periods or repeated postponements. It is expressly stated that scheduling a tandem jump for a specific date or time does not guarantee its execution. The tandem passenger implicitly accepts that CERPS and its parachutists' obligations take precedence over the passenger's interests in case of conflict.
Grouping Requests CERPS is not obligated to group tandem passengers or AFF students on the same flight even if they know each other.
Medical Requirements The tandem passenger certifies compliance with medical criteria established by Belgian Parachuting Federations. Any health condition affecting the jump must be reported to the Tandem Master beforehand.
Right of Refusal CERPS reserves the right to refuse a jump if valid reasons oppose or compromise safety. In such cases, the amount paid may be refunded under point 2.b, subject to the conditions in point 11.
Passenger Misconduct No refunds will be provided if the jump is refused due to passenger actions such as: a. Violating aeronautical or CERPS rules, including alcohol or drug use before the jump. b. Ignoring CERPS staff instructions. c. Endangering themselves or others.
Privacy Policy a. Personal data may be processed for operations related to financial or insurance matters. b. Participants agree to CERPS’s GDPR-compliant privacy policy. c. CERPS may conduct random alcohol or drug tests; a positive result leads to jump refusal without refund.
Media Rights a. By jumping, participants consent to being filmed/photographed for CERPS media. b. All media rights are reserved by CERPS, and participants cannot request compensation.
Payment Methods a. Bank transfer based on provided details. b. Cash or card payment on the day of the jump.
Gift Voucher Holders Jumps are conducted only upon presentation of the original voucher on the jump day.
Liabilities CERPS is not responsible for personal property damages, losses, or theft.
Damages, Theft, and Losses a. No legal action can be taken against CERPS or any individuals affiliated with CERPS for accidental damages to the personal belongings of tandem passengers, AFF students, or their companions during the briefing, the plane ride, the jump, or the landing. b. No legal action can be taken against CERPS or any individuals affiliated with CERPS for the loss of personal belongings. c. No legal action can be taken against CERPS or any individuals affiliated with CERPS for damages or theft occurring in the parking lot or on CERPS premises.
Pets CERPS does not allow dogs on its premises.
Prohibited Items Any cigarettes, sharp objects, liquid or corrosive substances, or other items causing damage to equipment necessary for this sport will be the responsibility of the individual or legal guardian who caused the damage.
Compliance with Aerodrome Rules Every visitor must adhere to the aerodrome rules and observe any oral or written prohibitions or advice.
Right of Entry CERPS reserves the right to deny entry to its premises.
Internal Rules All individuals performing a jump at CERPS and their companions must comply with CERPS' internal regulations.
Minors For minors, a written authorization from a parent or legal representative, along with a copy of the ID of both the parent/legal representative and the minor, is required to perform a jump. CERPS declines all responsibility if the individual providing written authorization is not the actual legal representative or if the other parent does not consent to the authorization.
TO BE DECLARED FIT TO PERFORM PARACHUTE JUMPS, THE CANDIDATE MUST MEET THE FOLLOWING CONDITIONS:
Tandem Passenger
Maximum passenger weight: 95 kg.
Minimum height: 1.20 meters, with written parental consent or that of a legal guardian, accompanied by a copy of the ID card of the parent/guardian and the minor. The presence of parents or legal guardians is mandatory for those under 18.
AFF Student
Maximum student weight: 95 kg.
Cardiologist approval: Recommended every 2 years for individuals over 50.
Official medical certificate: Must be completed by a doctor using the CERPS template available on our website. No other certificate will be accepted.
Minimum age: 16 years old in the year of training commencement, with written parental consent.
The candidate must have a good general physical condition without requiring significant muscular development. Any obesity will be assessed based on its functional impact.
The candidate must possess a normal abdominal wall. Hernias, weaknesses, or lesions of the abdominal wall that contraindicate the effort of jumping are disqualifying. Major surgical procedures related to the abdominal wall must have occurred more than three months prior.
Interventions on major blood vessels and arterial circulation in the lower limbs are generally contraindications.
The candidate must have full functional integrity of the respiratory system, which must show no clinical signs of tuberculosis. Any cases of asthma or emphysema require pulmonary examination.
Serious digestive disorders that may pose a risk of sudden incapacity are left to the discretion of the examining physician.
Any history of trauma or lesions of the brain or skull must undergo a thorough neurological examination. An ECG is subject to the discretion of the examining physician.
Candidates exhibiting excessive emotionality, a neurotic state, personality disorders, or other behavioral anomalies raising reasonable doubt about their ability to jump will be disqualified.
Any history of cardiovascular disease requires a thorough cardiological examination.
Candidates must be free from conditions affecting the spine, pelvis, or limbs that could pose safety risks during normal jumping conditions.
Candidates must not exhibit signs of chronic or acute medication or substance intoxication, and must not be under the influence of alcohol, drugs, or any other substances impairing cognitive abilities.
For female candidates, pregnancy is an absolute contraindication.
